Purpose

Our HOA is a non-profit organization legally established by Ward Development at the inception of The Reserve on Higgins Creek community.  The purpose of this corporation shall be to promote the health, safety, and general welfare of the members of the Association, and to fulfill these general purposes the Association may:

  1. Operate and function exclusively as a non-profit corporation with the right, powers, and privileges permitted by the South Dakota Non-Profit Corporation Act;
  2. Maintain any existing or after-acquired common areas;
  3. Acquire, own, hold, maintain, improve, lease, grant and obtain easements, sell, convey, mortgage, and otherwise deal with the property or lots in the Association;
  4. Fix and collect assessments, fines, and charges to be levied against lots in the Association;
  5. Establish, administer, and enforce any and all covenants, conditions, restrictions, reservations and agreements, and amendments to any of the same, applicable to the Association;  and
  6. Perform such other acts and functions as may be reasonable or necessary for the general benefit and welfare of the owners of the lots subject to the terms and conditions of the Association.

The corporation shall not be organized nor operate for profit nor shall it participate, or intervene, directly or indirectly, in any political campaign on behalf of or in opposition to any candidate for public office.

Our HOA does not replace or supersede City or County or Federal laws and ordinances.

Our Dues

Your annual homeowner dues are $60 per year for lot sizes less than 8000 square feet, and $100 per year for lot sizes 8000 square feet and larger.

All homes in The Reserve on Higgins Creek are automatically included in the Homeowners’ Association as required by the Declaration of  Covenants. Dues are an annual obligation and used for the reasons stated in the Covenants which include expenses related to the enforcement of the Covenants. Please refer to the Covenants for further details on policy and procedures for the enforcement of Covenants. The due date for payment of your dues is March 31st of every year. Dues paid after the due date will accrue additional interest. The Board of Directors thanks you for your cooperation.

Changes to your property

If you are planning on undergoing any renovations or changes to your property and are going to have construction debris / equipment and/or a dumpster located on your property, please notify the HOA prior to having the work started by utilizing the “Ask a Question” function on the website to let the Board know.

Just a reminder – all new construction, building additions, and proposed fencing must be approved by the Architectural Control Committee prior to installation. Please see the Documents & Resources tab above to locate and print the appropriate Architectural Review Committee (ARC) application form.  Complete the form and submit to the Board of Directors.  Thank you!

Message to New Members

Dear New Homeowner,

Welcome to our neighborhood and congratulations on the purchase of your new home!

On behalf of the Reserve on Higgins Creek HOA Board and the other homeowners in the Reserve, we would like to welcome you to our neighborhood! Over the coming months we look forward to meeting you whether it be walking down the street or at one of our meetings.

The goal of this HOA is to maintain and enhance the property values for our members. The board is made up of your neighbors, volunteering their time. If you have an interest in helping out please let us know.

When you purchased your home, your realtor should have provided you with a copy of our HOA covenants or a link to our covenants. Please look through these at your convenience and let us know if you have any questions. If you have previously lived in Spearfish, you will notice that many of our covenants mirror the city’s ordinances. For example, mowing of lawns, parking in the streets, etc. We ask that if issues arise please let us know and we can point you in the right direction. Keep in mind, per the covenants, if you want to do any architectural improvements to your property, these will need to be approved by our architectural committee. The proper forms can be found on our website.

Most of the properties in this neighborhood have an HOA due of $100 a year. Black Hills Bookkeeping will mail the bills out in January every year. They only do the bookkeeping for the HOA, so if you have questions or concerns, please contact us through the website. Your HOA due covers any maintenance of green spaces (mowing, landscaping, weed control), bookkeeping, and lawyer fees. In the coming years, there are plans to work with the city for possible park space and more green space for our neighborhood.

We have an annual meeting once a year in February, when we elect new board members and appoint officers. This meeting will be announced and signs will be posted. As a board, we try to meet once a month and members are allowed to attend and given time at the beginning of the meeting to ask questions.
